Privacy Policy

01Who we are

Studio Noir is a creative platform operated by Heliosync Technologies Private Limited, a company incorporated in India (“Heliosync”, “we”, “us”). This policy explains what personal data we collect when you visit studionoir.in or use the Studio Noir workspace, why we collect it, and the choices you have.

For the purposes of India’s Digital Personal Data Protection Act, 2023, we are the data fiduciary for account and usage data. For the content you upload to your workspace, we process it on your behalf and on your instructions.

02What we collect

We collect only what we need to run the service:

• Account details: your name, email address, password (stored hashed), role and the workspace you belong to.
• Workspace content: the brands, products, brand kits, campaign briefs, choices, comments and approvals you create in Studio Noir.
• Uploads: product photos, logos, videos, reference material and any other files you add, together with the campaign assets produced from them.
• Usage data: how you use the product (pages viewed, features used, credits spent), device and browser type, approximate location derived from IP address, and diagnostic logs.
• Billing details: plan, invoices, billing address and tax details such as a GSTIN. Card and payment details are handled by our payment provider; we do not store full card numbers.
• Messages: what you send us by email or through the contact form.

03How we use it

• To provide the service: create your account, produce and store your campaigns, and deliver exports.
• To bill you, keep records we are required to keep, and prevent fraud and abuse.
• To support you, answer your messages and tell you about changes to the service.
• To keep Studio Noir secure and reliable, and to understand, in aggregate, which features are used so we can improve them.
• To send product news, only if you have agreed to it. You can unsubscribe at any time.

We rely on your consent, on the performance of our agreement with you, and on the other lawful grounds permitted by applicable law. Where we rely on consent, you can withdraw it at any time.

04How your uploads are used

Your uploads and the campaign assets made from them belong to your workspace. We use them only to produce and deliver your campaigns and to operate the features you choose, such as the Brand Kit, the Library and the Reference Lab.

• We do not sell your uploads or campaign assets, and we never share them with other customers.
• We do not feature your work in our showcase or marketing without your written permission.
• We do not use your uploads or outputs to improve services offered to other customers without your explicit permission.
• Production partners that process files on our behalf may only do so on our instructions, under confidentiality obligations, and for the purpose of producing your campaign.

05Who we share data with

We share personal data only with:

• Service providers who help us run Studio Noir, such as cloud hosting and storage, content delivery, production processing, payments, email and customer support, under written agreements that limit their use of the data.
• Authorities, when the law requires it or to protect the rights, safety and property of our users or of Heliosync.
• A successor, if Heliosync is involved in a merger, acquisition or sale of assets, in which case this policy continues to apply to your data.

We do not sell personal data.

06Cookies and analytics

The workspace uses essential cookies and similar storage to keep you signed in and to remember preferences. The marketing site uses a small amount of local storage for conveniences such as your chosen currency.

We may use privacy-respecting analytics to count visits and understand which pages are useful. [Name the analytics provider before launch.] We do not use advertising or cross-site tracking cookies. You can block cookies in your browser; the workspace will not work without essential ones.

07Where data is stored

Data is stored with reputable cloud providers. [Confirm hosting regions before launch.] If data is processed outside India, we do so only where the law permits and with safeguards in our contracts with those providers.

08How long we keep it

• Account and workspace content: for as long as your account is active.
• After you delete content or close your account: removed from active systems within [30] days, and from backups within [90] days.
• Billing and tax records: for as long as Indian law requires, typically eight years.
• Diagnostic logs: for a short period, usually no longer than [90] days.

09Security

We protect data with encryption in transit, encryption at rest where our providers support it, access controls based on least privilege, and monitoring. Access to customer files is limited to people and systems that need it to run the service.

No system is perfectly secure. If a breach affects your personal data, we will notify you and the relevant authorities as the law requires.

10Your rights

Subject to applicable law, including the Digital Personal Data Protection Act, 2023, you can:

• Ask for a summary of the personal data we hold about you and how we use it.
• Correct, complete or update it.
• Ask us to erase it, unless we must keep it by law.
• Withdraw consent you have given.
• Nominate someone to exercise these rights on your behalf in the event of death or incapacity.
• Raise a grievance with us, and then with the Data Protection Board of India if you are not satisfied.

Most account and workspace data can be edited or deleted from Settings. For anything else, write to heliosynctechnologies.pvtltd@gmail.com. We will respond within the time the law requires.

11Children

Studio Noir is a business tool and is not intended for anyone under 18. We do not knowingly collect personal data from children. If you believe a child has given us personal data, contact us and we will delete it.

12Changes to this policy

We will update this policy as Studio Noir grows. When changes are significant we will tell you by email or in the workspace before they take effect. The date at the top shows when it last changed.
